01 The agreement
These Terms & Conditions (“Terms”) form a binding agreement between you and CalmPilot AI (“we”, “us”, “the app”). By installing, opening, or using the CalmPilot AI mobile application you confirm that you have read and accepted these Terms. If you do not accept them, please do not use the app.
02 Eligibility
You may use CalmPilot AI if you are at least 13 years old (or the minimum age in your country, if higher — for example 16 in parts of the EU/EEA). If you are a minor, you confirm that a parent or legal guardian has reviewed these Terms and agrees on your behalf.
03 Account & access
The app does not require a name or email to use. Your installation is identified by a device-generated ID. You are responsible for the device you install the app on and for keeping it reasonably secure (screen lock, biometric lock if available).
You may use the app only on devices and operating systems we currently support. We may discontinue support for older versions over time.
04 Allowed and prohibited use
You may use CalmPilot AI for personal, non-commercial purposes — to log your moods, talk to Milo, play the games, and listen to the audio sessions.
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except to the extent permitted by applicable law.
- Copy, modify, distribute, sell, or sublicense the app or any of its content.
- Use the app to harass, threaten, defame, or harm any person, including by misusing Milo to generate harmful content.
- Attempt to disrupt, overload, or probe the security of the app or its servers.
- Use the app for any unlawful purpose or in violation of any applicable law.
- Misrepresent your age or use the app on behalf of someone who has not consented.
05 Wellness, not medical advice
CalmPilot AI is a wellness tool. It is not a medical device, diagnostic service, therapy provider, or substitute for qualified professional care.
- Content in the app — including AI replies, mood insights, audio sessions, and games — is for general wellness and educational purposes only.
- We do not provide medical, mental-health, psychological, legal, or financial advice.
- If you are experiencing a mental-health crisis, thoughts of self-harm, or any medical emergency, contact your local emergency services or a qualified clinician immediately.
06 AI content and Milo
Milo is an AI assistant. Its responses are generated dynamically and may sometimes be inaccurate, incomplete, or out of date. You should not rely on Milo for decisions that require professional judgement.
You agree not to use Milo to (a) seek diagnoses or treatment plans, (b) generate harmful, illegal, or deceptive content, or (c) impersonate other people. We may rate-limit or block prompts that violate these Terms.
07 Intellectual property
The app, its design, its software, its name “CalmPilot AI”, the Milo character, the games, audio sessions, and all related content and trademarks are owned by us or our licensors and are protected by copyright and other laws. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose.
Nothing in these Terms transfers any intellectual-property rights to you. All rights not expressly granted are reserved.
08 Your content
The mood entries, notes, and chat messages you create remain yours. By using the app you grant us a limited licence to store and process them on your behalf so the app can function — for example, displaying your mood history, generating AI responses, and producing your weekly insights.
We do not use your personal entries for advertising, and we do not publish them. See our Privacy Policy for full detail.
09 Limitation of liability
The app is provided “as is” and “as available”. To the maximum extent permitted by law:
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the app.
- Our total aggregate liability for any claims relating to the app is limited to the amount you have paid us in the 12 months before the claim arose, or USD 50, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. Where it does not, our liability is limited to the smallest extent permitted by law.
10 Termination
You may stop using the app at any time and delete it from your device. To delete your data as well, use Settings → Delete account in the app or contact us.
We may suspend or terminate your access if you breach these Terms, misuse the service, or attempt to harm other users or our systems. Where appropriate, we will give you notice and a chance to remedy the issue first.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.
11 Changes to these terms
We may update these Terms as the app evolves or as laws change. Material changes will be notified in-app and by updating the effective date at the top of this page. Continued use of the app after changes take effect means you accept the updated Terms.
12 Governing law
These Terms are governed by the laws of the country in which CalmPilot AI’s operating entity is registered, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are not affected.
